A case heard by the Beijing International Commercial Court won the second prize of the first Outstanding Achievements of People's Courts in Judicial Cooperation Related to Hong Kong, Macao and Taiwan, on April 15.
In this case the "Arrangement of the Supreme People's Court Concerning the Mutual Enforcement of Arbitral Awards between the Mainland and the Hong Kong Special Administrative Region" was accurately understood and applied. It was also clearly pointed out that when there are procedural issues such as arbitrators’ disclosure and avoidance, the court should review the case based on the arbitration rules and social experience, and determine whether the issues are serious enough to affect the impartiality and independence of the arbitration.
