Request for the recognition and enforcement of an arbitral award and appendix granted by the International Commerce Center between Alter Farmacia, S.A. and the respondents, (Youzhiyuan (Beijing) Nutrition Food Co., Ltd and Beijing Hexinxingtong Trading Co Ltd)

Abstract of judgment:

The court held that Alter Farmacia, S.A. was an eligible party in the case because it had submitted proofs of the dispute subject, a certificate of its legal representative and a notarized letter of attorney and that there was no problem in the application signed by its agents for the recognition and enforcement of an arbitral award. The litigation didn't belong to any circumstances that the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards refuses to admit or to enforce, so there were no conditions prescribed in Article 5 of the convention. Therefore, the court granted recognition and enforcement of the No. 24059/JPA(C-24070/JPA) Arbitral Award and the No. 24059/JPA (C-24070/JPA) Appendix issued by the International Commerce Center on February 8, 2020 and May 22, 2020.
